The US Citizenship and Immigration Services (USCIS) issued the guidance, outlining revised eligibility criteria for Employment Authorization Document (EAD) applications, both initial and renewal, in compelling circumstances.
This new policy set to alleviate the prolonged wait for permanent residency faced by Indian professionals. And offer them an opportunity to work and reside in America.
Green card
A Green Card, officially known as a Permanent Resident Card, is a crucial document that grants immigrants the privilege of residing permanently in the US.
However, immigration laws restrict the annual issuance of employment-based Green Cards to approximately 140,000 individuals. Thus, only seven percent allotted to applicants from a single country.
Under the USCIS guidance, specific requirements must met by applicants to qualify for an initial EAD based on compelling circumstances.
These requirements include being the principal beneficiary of an approved Form I-140.
Thus, maintaining valid non-immigrant status or an authorized grace period, not having filed an adjustment of status application. And meeting specific biometric and criminal background criteria.
Additionally, the USCIS will exercise discretion in determining whether applicants demonstrate compelling circumstances warranting employment authorization.
